Terms and Conditions: the artist shall retain all rights to the artwork. The artist hereby warrants that the artwork is an original work of the artist, does not contain any third party copyrighted material or material that is subject to other third party proprietary rights, and that the artist has the full right, power, and authority to sign this Submission Form and Agreement and to grant the rights agreed to be granted hereunder. The artist agrees that the artwork is being submitted at the artist’s own risk. The artist further agrees that Bell County Comic Con shall not be responsible or have any liability for any damage, loss, or theft of the submitted artwork at any time. The artist hereby agrees to defend, indemnify, and hold harmless Bell County Comic Con from and against any and all claims, liabilities, damages, costs, or expenses (including, without limitation, reasonable attorneys’ fees) arising from any breach by the artist of any representation or warranty made hereunder. The artist acknowledges that no compensation other than what is stated in this Submission Form and Agreement will be provided by Bell County Comic Con or any third party. For good and valuable consideration received, the artist hereby releases and discharges Bell County Comic Con, their principals, officers, trustees, representatives, employees, agents, licensees, successors, and assigns from any and all claims, demands, or causes of action that the artist may now have or may hereafter have for libel, defamation, invasion of privacy or right of publicity, infringement of copyright or violation of any other right arising out of or relating to any utilization of the artwork, or the artist’s name, likeness, or biographical information or the exercise of any of the rights granted by this document. The artists’ submission of artwork constitutes their representation of compliance and acceptance of these Official Rules and their consent for Bell County Comic Con to obtain, use, and transfer their name, address, and other information for the purpose of Contest administration. The artist will defend, indemnify, and hold harmless Bell County Comic Con and its agents from and against any liability, loss, injury, or damage of any kind (including attorneys’ fees) to any person or entity, including, without limitation, personal injury, death, or damage to personal or real property, due in whole or in part, directly or indirectly, by reason of participation in this Contest. Bell County Comic Con, in their sole discretion, reserve the right to cancel or modify this program, without liability. This contest is governed and construed under the laws of the state of Texas and the venue for any action, claim, or dispute arising hereunder shall be in Bell County, Texas. Each artist waives any and all objections to jurisdiction and venue in those courts and hereby submits to the jurisdiction of those courts. All federal, state, and local laws and regulations are applicable. I have read the foregoing Rules, Guidelines, and Terms of Participation before checking the box below, and warrant that I am entering this contest voluntarily, and fully understand the contents thereof.
